Information on the processing of personal data

Maierhofer Brida S.r.l., henceforth ‘maierhofer’, considers the protection of confidentiality to be an essential value, which is why it is careful to process and store the personal data communicated to it in a lawful and correct manner, in full transparency and with a high level of security.

In compliance with Legislative Decree No. 196 of 30 June 2003, (Privacy Code, hereinafter also CP), we would like to inform you about the way in which maierhofer processes your data and the rights that you, as a data subject, are entitled to.

1) Purpose and method of processing

In order to fulfil the service provided through the website www.maierhofer.it, hereinafter referred to as the ‘Service’, maierhofer must acquire, or already holds, certain personal data concerning you.
All personal data provided by you to maierhofer are processed by maierhofer, in electronic and paper form, to the extent strictly necessary for the best fulfilment of the obligations arising from the provision of the Service, as well as for the purpose of optimising the services offered to you.

The above-mentioned purposes include the fulfilment of obligations laid down by laws, regulations and EU rules as well as provisions issued by authorities empowered to do so by law or by supervisory and control bodies (e.g. anti-money laundering regulations). The provision of the data required for legal purposes is obligatory and is necessary for the establishment of the contractual relationship itself.

Certain personal data are necessary for the provision of the Service and for the performance of obligations arising therefrom. In particular, in order to be contacted by maierhofer, you must provide us with your name and telephone number.

Similarly, the communication of other personal data is necessary for the provision of the Service and for the performance of the obligations arising from the contract you have signed with maierhofer in accordance with the legal provisions in force. Therefore, in the event of your refusal to communicate such data, maierhofer would be unable to provide the requested Service and to execute it.

Maierhofer guarantees that the processing of your personal data is always carried out using manual and computerised means that are suitable to guarantee the security and confidentiality of the data. The high level of security of the computer system is a quality standard within maierhofer.

2) Communication

Your data may be disclosed:

• to persons to whom the law, regulations or EU rules grant such right of access, within the exclusive limits granted by law and solely for the purposes therein expressed;
• companies, bodies or consortia to which maierhofer may turn for the performance of operations necessary for the execution of instructions received from you and the provision of services requested. These companies are direct collaborators of maierhofer and perform the function of “Processor” or operate as separate “Holders” of the relative processing, in total autonomy. These are, in particular, companies that provide payment services, tax collection and treasury offices, financial companies, credit institutes, companies that carry out maintenance in various capacities, massive processing relative to payments, cheques and other securities; transmission, enveloping, transport and sorting of communications; contract census; registration, management and archiving of the documentation relative to relations with clients, auditing and certification of financial statements.

Here too, care will be taken to process your data in accordance with the principles of lawfulness and correctness and above all within the limits of strict necessity. In communication activities, the same security parameters required by law are complied with, and processing will only pursue the purposes for which the data was collected.

In any case, your personal data will not be disseminated.

3) Rights of the data subject

Pursuant to Article 7 of the Privacy Code, as a data subject, you have the right to be informed: a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied in the event of processing carried out with the aid of electronic instruments; d) of the identification details of the data controller, data processors and the representative designated pursuant to Article 5(2); e) of the entities or categories of entity to whom or which the personal data may be communicated or who or which may become aware of the data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

Furthermore, the data subject is entitled to obtain:

a) the updating, rectification or, when interested, the integration of data;

b) the deletion, transformation into anonymous form or blocking of data processed in breach of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;

c) certification that the operations referred to in points a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, unless this proves impossible or involves a manifestly disproportionate effort compared to the right protected.

The data subject has the right to object, in whole or in part:

a) for legitimate reasons to process personal data concerning him/her, even if pertinent to the purpose of collection;

b) the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
